I. Acceptance of Terms
Welcome to DeLaado! By accessing or using our services through the website at https://delaado.in (the "Site") and our mobile application ("DeLaado"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use our services.
II. Definitions
"Customer," "You," or "Your": Refers to individuals who use the DeLaado Platform to order food.
"Restaurant Partner(s)": Refers to local restaurants in Raxaul, Bihar, that have partnered with DeLaado to offer their menu items through our platform.
"Delivery Partner(s)/Person(s)": Individuals or entities responsible for delivering orders from Restaurant Partners to Customers.
"Content": Includes reviews, images, photos, and any other information or data shared by Customers on the DeLaado Platform.
"Payment Providers": Third-party services facilitating payments on the DeLaado Platform, specifically Razorpay and PayU.
III. Eligibility
By using DeLaado, you represent and warrant that you are at least 18 years old and capable of entering into a legally binding agreement. You agree to use the Services in compliance with all applicable local laws and regulations.
IV. Account Registration
Creating an Account: To place orders, you must create an account by providing accurate and complete information. DeLaado allows account creation through Gmail login as well as a custom signup option where users can enter their email and create a password. We verify ownership through OTP sent to their phone number and email.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Third-Party Accounts: By using Gmail to log in, you authorize DeLaado to access certain information from your Gmail account in accordance with Google's privacy policies.
V. Use of the DeLaado Platform
Ordering Process: By placing an order through DeLaado, you authorize us to process the order with the selected Restaurant Partner and facilitate delivery.
Payment:
Online Payments: We facilitate secure payments through third-party payment providers Razorpay and PayU. By choosing these methods, you agree to adhere to the respective payment providers' terms and conditions.
Cash on Delivery (COD): DeLaado also offers Cash on Delivery as a payment option. COD payments are collected by Delivery Partners and deposited to DeLaado the next business day.
Delivery: Delivery times are estimates and may vary based on various factors. DeLaado is not liable for delays beyond our control.
VI. Content and Conduct
User Content: You may post reviews, ratings, and other content related to your experience with Restaurant Partners. You retain ownership of your content but grant DeLaado a license to use, display, and distribute it.
Prohibited Content: You agree not to post content that is unlawful, defamatory, obscene, or infringes upon the rights of others.
Monitoring: DeLaado reserves the right to monitor and remove any content that violates these Terms or is otherwise objectionable.
VII. Intellectual Property
Ownership: All content on the DeLaado Platform, excluding user-generated content, is the property of DeLaado or its licensors and is protected by intellectual property laws.
Restrictions: You may not reproduce, distribute, or create derivative works from DeLaado's content without explicit permission.
VIII. Privacy Policy
Your use of DeLaado is also governed by our Privacy Policy, which can be found at https://delaado.in/privacy. By using our services, you consent to the practices described therein.
IX. Limitation of Liability
DeLaado shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services. Our total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you have paid us, if any, in the last six (6) months.
X. Indemnification
You agree to indemnify, defend, and hold harmless DeLaado, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Services or your violation of these Terms.
XI. Termination
DeLaado reserves the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.
XII. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bihar, India.
XIII. Changes to Terms
DeLaado may modify these Terms at any time by posting the updated version on the Site. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
XIV. Additional Terms and Conditions
1. Delivery Terms:
Delivery Areas: Currently, DeLaado operates within Raxaul, Bihar. Expansion to nearby areas will be governed by updated Terms.
Delivery Fees: Delivery fees vary based on distance, order value, and other factors. These fees will be clearly displayed at the time of ordering.
Delivery Time Estimates: Provided at the time of order placement; actual delivery times may vary.
2. Cancellation and Refund Policy:
Order Cancellation: Customers can cancel orders before the Restaurant Partner begins preparation. Cancellation policies may vary by Restaurant Partner.
Refunds: Refunds for cancelled orders will be processed through the original payment method within 5-7 business days. For Cash on Delivery (COD) orders, refunds will be processed via bank transfer or UPI within 1-2 business days after receiving the necessary details from the customer.
Processing Delays: Refund times may vary depending on the bank or payment provider. Customers will be notified via email/SMS once the refund is initiated.
3. Dispute Resolution:
Between Customers and Restaurant Partners: DeLaado acts as an intermediary and does not arbitrate disputes. Customers are encouraged to contact Restaurant Partners directly for resolution.
DeLaado’s Role: In cases where DeLaado is involved, disputes will be handled through our Grievance Redressal Mechanism as detailed below.
4. Promotions and Discounts:
Promotional Codes: May be offered from time to time and are subject to specific terms and conditions.
Loyalty Programs: Details of any loyalty or rewards programs will be provided separately and governed by their own terms.
5. User Responsibilities:
Accurate Information: Customers must provide accurate and complete information during account creation and order placement.
Compliance: Users must comply with all applicable laws and refrain from prohibited activities as outlined in these Terms.
6. Disclaimer of Warranties:
As-Is Basis: Services are provided "as is" without warranties of any kind.
No Guarantees: DeLaado does not guarantee the quality, safety, or legality of any Restaurant Partner's offerings.
XV. Grievance Redressal Mechanism
1. Customer Care Channels
Chat Support: Available on the DeLaado app for real-time issue resolution.
Email Support: Reach us at support@delaado.infor order-related grievances. A unique ticket number will be provided for tracking.
Escalation: If not satisfied with initial support, escalate to our Grievance Officer with your ticket number for resolution within forty-eight (48) hours.
2. Grievance Redressal Mechanism
For any complaints or grievances related to orders, payments, or any other concerns, you can reach out to us at support@delaado.in. We are committed to addressing all grievances in a timely manner. As DeLaado continues to grow, we will appoint a dedicated Grievance Officer and Nodal Officer for regulatory compliance, and their details will be updated in this section accordingly.
XVI. General Terms
1. Interpretation: Section and subject headings are for reference only and do not affect interpretation.
2. Entire Agreement and Waiver: These Terms, along with the Privacy Policy and any other relevant policies, constitute the entire agreement between you and DeLaado regarding the Services. Failure to enforce any provision does not constitute a waiver of that provision.
3. Severability: If any provision is found unlawful, invalid, or unenforceable, it shall be severed, and the remaining Terms shall remain in full effect.
4. Partnership or Agency: No partnership or agency relationship is created between you and DeLaado. You have no authority to bind DeLaado.
5. Governing Law/Waiver: Governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Bihar, India. Legal actions must commence within one (1) year of the alleged harm.
6. Carrier Rates May Apply: Accessing the Services via mobile or other devices may incur charges from your Internet or mobile service provider. You are responsible for such costs.
7. Linking and Framing: You may link to the Services, provided you do not link to inappropriate or unlawful content. Framing DeLaado's content without permission is prohibited.
XVII. Notice of Copyright Infringement
DeLaado respects intellectual property rights and expects users to do the same. If you believe that your copyrighted work has been infringed upon via the DeLaado Platform, please follow the procedure below to file a notification:
• Identify the copyrighted material that you claim has been infringed.
• Identify the location of the infringing material on the DeLaado Platform.
• "I have a good faith belief that the use of the content on the Services as described above is not authorized by the copyright owner, its agent, or law."
• "I swear under penalty of perjury that the information in my notice is accurate and I am the copyright owner or authorized to act on the copyright owner's behalf."
• Provide your contact information including address, telephone number, and email address.
• Provide your physical or electronic signature.
• Send your written communication to legal@delaado.in.
Important: You may be subject to liability if you knowingly make any misrepresentations on a take-down notice.
